Milne Moser’s Family Department recently spent time with St John’s Chambers to discuss the forthcoming changes to private law children proceedings and what they will mean for families involved in the Family Court process.
The scheme, formerly known as the Pathfinder Pilot, has now been renamed the Child Focused Court and is being rolled out more widely following a successful trial. Cumbria and Lancashire are two of the next eight court areas due to adopt the new approach, within 2026/2027 financial year. This means local families and legal representatives will soon begin to see these changes in practice.
The introduction of the Child Focused Court represents one of the most significant changes to private law children proceedings in recent years. At the heart of the reform is the introduction of a Child Impact Report, prepared by Cafcass at the very start of proceedings.
Traditionally, private law children cases have often involved information being gathered gradually over a number of hearings, with concerns only becoming fully apparent as proceedings progress. This can result in a lengthy and fragmented process for families, with decisions delayed while further enquiries are undertaken.
The new approach seeks to reverse that process. With a detailed understanding of the child’s circumstances, safeguarding concerns and the impact of parental conflict from the outset, the court is better equipped to identify the issues that need addressing from the start of the case. This marks a notable shift away from a system that has historically been driven by the evidence emerging during proceedings, towards one where the child’s experience informs the court’s approach from the start.
The reforms reflect a wider move towards ensuring that children’s welfare remains at the centre of decision-making and, it is hoped, reducing unnecessary delay for families navigating the court process.
