What is Legal Aid?
Legal Aid ensures that people on low incomes in England and Wales can still access justice and receive professional legal advice when they need it most. If you meet the Legal Aid eligibility criteria, you can get support for issues such as domestic abuse, child protection, and care proceedings.
Who Can Get Legal Aid?
You may qualify for legal aid if your case involves:
- Domestic abuse or violence – including applications for protective injunctions.
- Child protection legal advice – where social services are involved or a child is at risk.
- Child arrangements disputes – especially where there is evidence of abuse or harm.
- Care proceedings solicitor support – when a local authority seeks to remove a child from your care.
- Forced marriage or FGM protection – specialist Legal Aid is available for these cases.
- Divorce and financial disputes – in limited cases where there is evidence of abuse or risk.
Legal Aid is also available to parents who need advice about child protection concerns, subject to income and capital limits. In some situations, such as when a local authority issues a Public Law Outline letter or starts care proceedings, Legal Aid is automatically available to anyone with parental responsibility.
Types of Legal Aid
There are two main types of Legal Aid:
- Legal Help (Controlled Work)
This covers initial advice and assistance from a solicitor. It does not include representation in court. - Legal Aid (Family Higher Work)
This covers issuing court applications and representation in court, whether you are an applicant or respondent.
